HENDERSON, KY (WFIE) - Henderson Mayor Tom Davis faces possible eviction of Wolf's Restaurant and Banquet Facility.
Mayor Davis has been renting the facility since 1998, but the allegations of non-payment have only been an issue since last year.
The complaint was filed by Virginia Priest Berland against Henderson Mayor Tom Davis' company DaWolf Incorporated.
Borland leases Wolf's Restaurant and Banquet Facility to Davis.
In a formal complaint filed in Henderson court this week, Borland claims DaWolf Incorporated owes over $24,000 dollars in unpaid rent, insurance and attorney's fees dating back to 2008.
Since 2008, the lease states DaWolf's is to pay just over $5,700 dollars in monthly rent.
The complaint states DaWolf's did not pay a portion of one month's rent back in 2008, nor any rent from February, March, April and May of this year.
The complaint says this summer, Borland and DaWolf's agreed to a lease extension of the restaurant and banquet facility under the condition dawolf would pay the outstanding rent in segments on top of regular monthly rent payments.
Berland claims DaWolf's has not paid anything since that lease extension agreement.
She filed suit in court this week.
The suit comes in the same year Davis' liquor license was suspended.
Davis would not talk on camera but says:
"My landlord and I are in a situation where we are trying to come to terms. She filed suit and I'm trying to answer it in court."
Davis is expected to be in court November 10.
That's when a judge could decide whether to have Davis evicted from the banquet facility.
